PREAMBLE

The Immunité Paris.com website (hereinafter the “Site”) is an electronic commerce space which offers a remote ordering and delivery service for products and associated services (order preparation, delivery, etc.) by IMMUNITÉ PARIS company (hereinafter referred to as “IMMUNITÉ PARIS”) (hereinafter the “Service”), under the conditions defined below.

    1. OBJECT

These General Terms and Conditions of Sale are concluded between the company IMMUNITÉ PARIS (hereinafter referred to as "IMMUNITÉ PARIS") and any major non-commercial individual located in one of the delivery zones served (see article 6 below. ) and wishing to make a purchase on the Site (hereinafter referred to as the “Customer”).

    1. ACCEPTANCE OF CONDITIONS OF SALE

By ordering Products on the Site, the Customer is invited to accept the General Conditions of Sale of the Immunité Paris.com site.   • Photographs and illustrations

The Customer is informed, subject to his rights, of the possibility of a difference in presentation on delivery of the Products ordered resulting from a modification of the packaging (photographs and illustrations) by the manufacturer, this difference not not in any way affecting the content and characteristics of the Products.

  • Promotional benefits

The Customer is informed that the Service does not allow the taking into account of promotional advantages such as in particular the coupons of any kind to be used on the purchase of a Product or for a minimum purchase amount, with the exception of those expressly applied to the Site.

  • Availability

The Product offers presented on the Site are valid while stocks last. It is also possible that one or more Product (s) of the Site ordered is not available at the time of preparation of the order.   1. SUBSCRIPTION

The price of the monthly subscription for a Product is 39 euros including tax.

The Subscription is non-binding and can be terminated at any time: the Customer can terminate their subscription at any time, with effect from the following month of the started month, by sending an email to IMMUNITÉ PARIS at the contact address @ immunite-paris.com. All months started and paid are due by the Customer.

When ordering, the Customer fills out a form so that IMMUNITÉ PARIS can prepare the order. The Customer expressly acknowledges and accepts that IMMUNITÉ PARIS does not verify the information provided. Thus, the Customer will assume all the consequences in the event of inaccuracy of the information provided, IMMUNITÉ PARIS cannot under any circumstances assume its liability in this regard.

The Customer acknowledges and accepts that the delivery of the Products may be suspended in the event of partial or total non-payment until full payment.

The Customer may terminate the Subscription:

via the following link accessible from his Personal Account before paying and sending the next package.

It is expressly agreed that IMMUNITÉ PARIS reserves the right to suspend the shipment of Products for one month. In this case, the Customer will not be debited for the amount of the Products concerned.

  1. ORDERS
  • Access to the service - Creation of a customer account

Access to the Service offered on the Site assumes the provision by the Customer of a computer and Internet access. Any costs for connection and use of the Site remain at its exclusive charge.

The Customer accepts the use of the Service provided by IMMUNITÉ PARIS as is.

The Customer who wishes to use the Service expressly undertakes not to use false information or information from third parties. To access the Service, the Customer must, before or after having created his basket, create his personal Customer Account by clicking on “My account” in order to complete the registration form using reliable, accurate and up-to-date data.

For this purpose, it must:

The Customer validates his payment after having verified it by clicking on the button "Place my order". From the moment the Customer has confirmed his order by clicking on this button, he is considered to have knowingly accepted the content and conditions of the order, the fact that his order implies a payment obligation on his part, the prices, volumes, characteristics, quantities and delivery times of the Products ordered.

When paying for the order, an authorization request is initiated with the payment center concerned. Any order can only be taken into account when the payment centers concerned have given their consent. In case of refusal from said centers, the order is not accepted and the Customer is notified by a message on the screen.

At the end of these 4 steps: the order is confirmed.

Once the Customer has validated their payment, a page confirms to the Customer the registration of their order.

The Customer then receives an email indicating:

Command limitations

For stock management reasons, IMMUNITÉ PARIS may limit the order by the Customer of the same Product to a certain quantity.

  1. PRICES AND TERMS OF PAYMENT
  • Price

Product prices are prices inclusive of VAT in euros including VAT applicable on the day of the order. They do not include preparation and delivery costs.

If delivery or transport costs apply, they will be added to the price of the Products and indicated separately before the Customer confirms the order. The total amount owed by the Customer and its details are indicated on the order confirmation page.

The delivery costs are specified during the finalization of the order and are accepted by the validation of the order.

Any change in the VAT rate may be reflected in the price of the Products and delivery costs. The subscription price for a Product is that appearing on the Site on the date of the order. The delivery costs, which are added to the total amount of the order, are shown on the order summary. The amount of the order that the Customer will have validated by proceeding to payment is the final price - all taxes included and including the amount of delivery costs - and the maximum that may be debited.   • Payment - method of payment

Payment can be made by credit card.

The bank cards accepted by IMMUNITÉ PARIS are as follows: Carte Bleue, Visa, Master Card. These payment cards must be issued by a banking or financial institution located in the European Union or in Monaco.

The Customer guarantees IMMUNITY PARIS that he has the necessary authorizations to use the payment method he has chosen for his order, when registering his order. Payment must be made at the time of ordering.

Any transmission of payment-related information takes place in a secure context. When paying by bank card, the transmission of a bank card number and its validity date, as well as its visual cryptogram (CVV) appearing on the back of the bank card used by the Customer, takes place in a context secured on the IMMUNITY PARI provider's server, in this case stripe.

The communication by the Customer of his bank card number constitutes authorization to debit his account up to the amount of the order and the duration of the current subscription.

Collection will only be carried out after dispatch of the order for the exact amount of the Products actually delivered to the Customer.

The Products ordered remain the property of IMMUNITÉ PARIS until full payment of their price by the Customer.

  1. DELIVERY
  • Delivery area

The delivery of the Products is ensured in Metropolitan France, Corsica included at the domicile or any other place designated by the Customer (relay point), by the Post Office or by the Carrier.

  • Delivery times

Deliveries are made at home from Monday to Saturday within 3 to 4 working days from the confirmation of the Customer's order by IMMUNITÉ PARIS.   • Delivery methods applicable to the Products

The delivery costs are the responsibility of the Customer.

The amount of delivery costs is indicated on the order summary.

  • Receipt of Products

The delivery date corresponds to the date and time of delivery or first actual presentation to the delivery address indicated by the Customer in the order form.

The transfer of risk takes place on delivery, when the Products are handed over to the delivery address provided by the Customer to the Post Office.

An identity document or any other necessary proof (including payment card used for the order) may be required upon delivery. In the event of refusal of presentation or of documents that do not correspond to the information provided when ordering, IMMUNITÉ PARIS reserves the right to cancel the sale.

Delivery takes place only at the landing of the Customer's delivery address; it cannot be carried out, even at the Customer's request, in a cellar, in front of or in a building hall.

If it is impossible to deliver the Products: the Carrier will leave a transit advice note in the Customer's letterbox. The latter will get in touch to set a new delivery date. If the Customer is absent from his home for delivery by post: the package will be delivered without signature to the Customer's letterbox.   • Damage

The Customer is invited to check the apparent condition of the package and the Products upon delivery.   • Legal warranty

The seller guarantor of the conformity of the products to the contract is:

In accordance with article 6.1. a) of the GDPR, the processing of Customers' personal data is based on the acceptance of these general conditions of sale and their implementation.

The data collected and processed is intended for:

- Authorized personnel from IMMUNITÉ PARIS,

- Sub-contractors of IMMUNITÉ PARIS acting within the framework of the purposes described above;

- Partners of IMMUNITÉ PARIS with the consent of the Client, if applicable.

Customers' personal data will not be transmitted to any unauthorized third party without their consent.

The personal data of Customers is kept for the duration of the contractual relationship with IMMUNITÉ PARIS, plus a period of 2 years in order to offer them Products and information on the services deployed by IMMUNITÉ PARIS, or with the Customer consent by IMMUNITÉ PARIS partners, then archived for a period of 10 years.

The personal data of Customers may be subject to statistical processing for purposes of evaluating use of the Site, without the possibility of identifying the Customer.

In application of the law of the Regulations, each Client is holder:

  • a right to access his personal data and request its rectification;
  • a right to delete his personal data;
  • the right to communicate instructions regarding the fate of personal data after death;

- commercial offers by mail, email, sms, telephone or via all the web spaces run by IMMUNITÉ PARIS on social networks, concerning services or products similar to those purchased by the Customer under these Conditions General Sales.

- subject to their express and specific agreement from the Customer, commercial offers by mail, email, sms, telephone or via all the web spaces run by IMMUNITÉ PARIS on social networks, concerning other content or services and / or offered by Partners of IMMUNITÉ PARIS.

The Customer has the option at any time to object free of charge to his commercial prospecting mailings, by clicking on the "unsubscribe" link.

PARTIAL INVALIDITY OF THE CONTRACT

In the event that one of the clauses of these General Conditions is null and void for any reason whatsoever, the validity and compliance with them will not be affected. The failure by IMMUNITÉ PARIS to exercise its rights recognized in application hereof does not, on its part, constitute a definitive waiver of the exercise of these rights.

  1. APPLICABLE LAW AND COMPETENT JURISDICTION

These General Conditions of Online Sale are subject to French law. In the absence of amicable settlement, disputes relating to orders placed on the Site are the exclusive jurisdiction of the French courts, notwithstanding multiple defendants or warranty claims.

These General Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text will prevail in the event of a dispute.
